1. Definitions

   Thecodewizarhub: Join the job market of the future, Thecodewizarhub is a web facilitated platform that provides programming courses to subscribers. You can start learning the basics and rules of different programming languages at your own pace and without leaving the comfort of your home. The courses will help you become a master in coding, and you will be able to apply the knowledge after each lesson. There are no limitations to the number of courses you can take. For those who want to get prepared for their first (or next) job interview in the tech industry, we have created an Interview Prep Section. There you will find many different questions that a job recruiter may ask.

   Thecodewizarhub Content: All content that can be accessed, downloaded, and interacted with on the Thecodewizarhub website. This includes, but is not limited to, interactive content, text, audio, video, photographs, graphics, artwork, and more.

   Membership:the agreement between the User and Thecodewizarhub to provide access to the Services for a period of time.

   Payment Method:the credit card, debit card, PayPal account, or other payment method that the User uses to pay for their Membership.

   Services:the interactive content, text, audio, video, photographs, graphics, artwork and more that are available through the Membership.

   Site Offerings: the Site, Services.

   Social Media Pages: Pages hosted on third-party websites that are related to Thecodewizarhub and are subject to the applicable agreements and Terms of Use of those Social Media Websites.

   Social Media Websites: Third-party websites where Thecodewizarhub's Social Media Pages are hosted.

   User: the person who registers for a Membership and provides their Payment Method information.

2. Agreement

   You meet the minimum age requirement (18 years), you inhabit in one of the countries Thecodewizarhub is operating and you are legally able to enter into binding contracts, as per applicable law. This Agreement is the sole and complete understanding between you and Thecodewizarhub about your use of the Site Offerings. Any offers or products made available to you on the Site that enhance or complement the current features of the Site Offerings will be subject to this Agreement, unless stated otherwise. Thecodewizarhub is not responsible if you are unable to use the Site Offerings.

   This Agreement may be revised or modified at any time without prior notification to you. Any disputes that occurred before the amendment of the Dispute Resolution Provisions, or charges incurred before the amendment of the Billing Provisions, will still be managed according to the Dispute Resolution Provisions and Billing Provisions in place at that time. To view the most up-to-date version of this Agreement, please visit Thecodewizarhub’s website. By continuing to use the Site Offerings, you agree to be bound by all applicable terms and conditions.

   By using Thecodewizarhub Services, you also acknowledge that you have read the Privacy Statement.

3. Registration

   In order to use certain Site Offerings, you may need to fill out a registration form (the “Form”). It will ask for information such as:

   • Your name
   • Mailing/billing address
   • Email address
   • Phone number
   • Credit card details (if buying Merchandise and/or Membership)
   • Any other information Thecodewizarhub requests

   By registering on Thecodewizarhub you agree to keep the information related to your security of the service confidential, to be responsible for all the consequences resulting from the use of your account and to pay your invoice every month until your subscription is terminated or cancelled.

   Your Registration Data must be accurate, current, and complete in order for us to keep it up to date. You can at any time change your address, user details and update your payment methods via “My Account”. Thecodewizarhub will consider the person or entity who has access to the email address as the owner of the Membership Thecodewizarhub retains the right to reject and/or terminate your Registration at any time for any reason, such as if Thecodewizarhub believes you have breached the Agreement, are engaging in improper conduct, or are conducting unauthorised commercial activity.

4. Fees

   It's important to make sure you're paying the correct price for your Membership, based on the country where you're registering. If the price you're charged is incorrect, please contact our customer support team at [email protected] for help. 5. Invoicing

   Upon registering for a Membership to the Thecodewizarhub, the payment method you provided or updated later will be automatically charged for the fees mentioned above. The date of the payments depends on the plan you will choose as also mentioned above. There is no obligation to stay - you can cancel your membership at any time. All fees will be paid in advance of the services being provided. You agree that Thecodewizarhub can charge your Payment Method without additional authorization.

   Once Thecodewizarhub has received your order, the services purchased will be available to you, according to the applicable terms. A confirmation email of your order with the description of the billing will be sent to the email you stated upon signing up for the subscription. If you have any queries regarding the delivery of your order, contact us at [email protected]. Darcy Tale sro reserves the right to issue digital or physical invoices and to work with a third-party factoring company if credit card payment is not made. All communication will be electronic or over the phone.

6. Trial Period

   By signing up for a membership through one of Thecodewizarhub campaigns, you give permission to Thecodewizarhub to deduct the trial period fee and then the complete recurring fee from the credit card you used upon continuing the service. When purchasing the trial subscription, you will not be charged for any undisclosed fees, just the amount mentioned in the campaigns. Your membership will be renewed automatically after the trial period and the date of the renewal depends on the plan you will choose. You can choose if the payment of the aforementioned fee will be conducted on your local price according to the “Pricing by country” list above or to the local currency of Czech Republic. You understand and accept that Thecodewizarhub will not require any additional authorization from you for this recurrent payment. Every time you use the Membership, you confirm that Thecodewizarhub has the right to charge your Payment Method and to apply the charges to the same.

7. Payment Methods

   All payments are made in your local currency through SSL encrypted connection with maximum safety. You can also proceed with the payment in the local currency of Czech Republic. You acknowledge and agree that any card and related billing and payment information that you provide are not stolen and will be shared with a third-party partner (Payment processor and/or Acquirer). The processing of payment by other Payment Providers shall be governed by such Payment Provider’s terms of service and Thecodewizarhub is not responsible in any way for your relationship with any such Payment Providers or for the actions of any of these Payment Providers.

   We reserve the right, at our sole discretion, to offer a discount on a subscription payment period without prior notification.

   Accepted Cards: Visa and MasterCard.

   In the event of failure on the collection of the Fees owed by you, you authorize Thecodewizarhub to retry and collect at a later time and Thecodewizarhub may in its sole discretion suspend or cancel your subscription without further notice. If a payment is not successfully settled due to expiration, insufficient funds or otherwise, and you do not cancel your subscription, you remain responsible for the uncollected amounts and Thecodewizarhub may suspend your access to the services until the successfully charged of a valid Payment Method.

   Billing Cycle: The Membership fee will be automatically deducted from your chosen Payment Method on the specific payment date mentioned in the reminder email. The duration of your billing cycle will vary depending on the subscription type you selected when signing up for the service. Your payment date may change if your payment method has not successfully settled or if you change your subscription plan. We have the sole discretion to provide a discount on a subscription payment plan without giving any prior notice.

   Thecodewizarhub will notify you by a reminder email with the date and time of the expiration of the trial period, the invoice of your purchase and these terms of use, 7 days before your trial period expires, or immediately after the purchase, if the trial period is shorter than 7 days.

   You acknowledge that you are responsible to ensure that your email can receive the confirmation and reminder emails. Thecodewizarhub is not responsible for any such failure and you are advised to provide an email service other than hotmail and gmail as those services may have issues regarding emails sent by Thecodewizarhub. If you have not received the emails, you may contact the Customer Support Centre.

8. Cancellation of Membership, Refunds and General Invoicing Provisions

   If you are not happy with your purchase, you can immediately end your Membership with Thecodewizarhub at any time by clicking (“Cancel Subscription”) and following the available instructions or by contacting the customer’s support centre through email/phone. Your account will remain active until the next billing cycle..

   Thecodewizarhub offers a 100% refund if it is requested within 14 days of your purchase. No refunds will be given for Membership fees already paid. All Membership fees are non-refundable and will be shown on your Payment Method statement under the specified identifier. Exceptions can be made on a case-by-case basis with the decision of the customer’s support team.

   Thecodewizarhub reserves the right to change their Billing Provisions at any time by posting the new fees on its Service. If you decide to continue using the Site or purchase a Membership after receiving the notice, you agree to be bound by the changes. By signing up with Thecodewizarhub and providing your Payment Method information, you are authorizing Thecodewizarhub to provide the Merchandise and bill you for it.

9. Termination

   Thecodewizarhub reserves the right to terminate your access to its services at any time without prior notice if you violate any clause of this Agreement. Your access may also be terminated on the same terms due to failure of fulfilment of payment obligations, usage of the service that may pose a risk to Thecodewizarhub or other users, engagement in illegal activities unethical actions that could harm Thecodewizarhub or other users, suspected fraudulent account activity and participation in any other unacceptable behavior described on the site and/or governing by the law. Upon termination, you acknowledge that Thecodewizarhub shall not refund any previously paid fees and you are obliged to pay any remaining charges prior to your termination.

10. Loss of Data, Content, and Capacity

    If your Membership is canceled or terminated, the user account, data in the normal course of operation and content will be deleted and cannot be recovered.

    The clauses of this Agreement relating to the protection and enforcement of Thecodewizarhub intellectual property, disclaimer of warranties, indemnification, limitation and governing law will remain valid after the cancelation or termination.

11. General Membership Terms

    Membership to the Thecodewizarhub website grants you access to various content, such as interactive content, text, audio, video, photographs, graphics, artwork and more (collectively referred to as “Thecodewizarhub Content”). Thecodewizarhub is solely responsible for the accuracy, completeness, appropriateness and usefulness of this content. Thecodewizarhub does not guarantee that all content posted by and through the website is accurate, and does not take any responsibility to monitor or police such content. You agree to release Thecodewizarhub from any liability in connection with any dispute between you and Thecodewizarhub.

    • disable or otherwise avoid any measures used to restrict access to Thecodewizarhub services.
    • sell for any commercial purposes access to Thecodewizarhub services except as permitted.
    • access or use the services in order to build a competitive product.
    • remove or notify any copyright notices, restrictions and signs indicating proprietary rights.
    • take any unreasonable actions that interfere the operation of Thecodewizarhub services.
    • to indemnify and hold harmless Thecodewizarhub for any violations of this agreement.

    You agree to indemnify and defend Thecodewizarhub, its parents, subsidiaries, and their respective members, officers, directors, employees, agents, co-branders, content licensors, and other partners from any and all claims, expenses, damages, suits, costs, demands, including attorney’s fee, and/or judgments made by a third party as a result of your inappropriate use of the Site Offerings, including violation of the copyright or privacy right, breach of this Agreement, any dispute between you and Thecodewizarhub, and/or violation of any rights of another individual or entity. 19. Limitation of Liability

    You understand and agree that Thecodewizarhub shall not be liable for any damages resulting from your use of the Site Offerings or any other services offered by them. This includes, but is not limited to, losses of profits, goodwill, data, use of the service, business interruption, inaccurate results, cost of recovering any data, cost of claims by third parties for damages to electronic devices and software or other intangible losses. Thecodewizarhub will not be liable to you or any third party up to the fullest extent permitted by law. You and Thecodewizarhub cannot bring any action more than one year after the event which caused the cause of action. The negation of damages is a fundamental element of the agreement between you and Thecodewizarhub .

20. Proprietary Rights/Intellectual Property

    The content provided by Thecodewizarhub service including graphics, text, design, images, artwork, audio, video, documents, digital conversion, copyrightable materials, methods, algorithm, data, inventions, trade secrets, logos, domains, trademark, tradename, title, software, services and other matters relating to them, are all subject to applicable intellectual property, right, copyrights and trademarks.

    Viewing any content does not grant you any ownership rights and posting any information or material through the site offering does not mean that any such rights have been waived. All rights of Thecodewizarhub or its licensors that are not expressly granted in this Agreement are reversed to Thecodewizarhub and its licensors.

21. Opt-Outs

    You are not able to opt out from transactional communication (billing and service messages) but you can opt out of receiving marketing and notification emails by clicking the “unsubscribe” link located at the bottom of the marketing messages or by contacting the Support Centre.

22. Dispute Resolution

    The Agreement shall be treated as if it were signed and carried out in Czech Republic and shall be governed by and interpreted in accordance with the laws of Czech Republic (without regard to conflict of law principles). If you have submitted a complaint to Thecodewizarhub but you consider the answer to be unsatisfactory, you can submit a dispute for resolution via an arbitration Settlement Offer. The arbitration shall be conducted in Czech Republic by a single arbitrator. Unless specifically required by applicable law, each party will bear their own legal costs, regardless of who is deemed the winner in the arbitration. Even though Thecodewizarhub may have the right to an award of lawyers’ fees and expenses if they are successful in arbitrating, they will not seek this from you unless the arbitrator finds that your claim was frivolous.

    Furthermore, to the extent allowed by law, you agree not to initiate, join or take part in any class action lawsuit related to any claim, dispute or controversy that you have against Thecodewizarhub and/or its employees, officers, directors, members, representatives and/or assigns. You agree to the entry of an injunction to stop such a lawsuit or to remove you as a participant in the suit. You also agree to pay the legal fees and court costs incurred by Thecodewizarhub in seeking such relief. This provision preventing you from initiating, joining or participating in class action lawsuits: (A) does not waive any of your rights or remedies to pursue a claim individually and not as a part of a class action in a binding arbitration as outlined above; and (B) is a separate agreement.

23. Notice for Claims of Copyright Violations

    If you believe that your copyrighted work has been infringed, you can submit a copyright infringement notification by providing Thecodewizarhub with the following information in writing:

    • telephone number, address, and email address
    • signature of the copyright owner or an authorized representative acting on their behalf with a statement for the authorization
    • description and details of the copyrighted work that you claim has been infringed and of where is located on the service.
    • statement affirming that you have a good faith belief that there is no authorization by the law or the owner or its agent for the usage of the work and that the above information is accurate.
24. Anti-Money Laundering Policy

    Thecodewizarhub complies with the applicable anti-corruption, anti-bribery and anti-money laundry laws and you acknowledge to also comply to all applicable laws including, local and Federal laws, EU directives and legally binding regulations, UN Convention and any other applicable laws such as the EU’s AML Directives, the UK Bribery, Money Laundering, Terrorist Financing, Transfer of Funds Act and Canada’s Corruption of Foreign Public Officials Act.

    Thecodewizarhub has the right to terminate you without prior notice if you fail to comply with any of the above..

25. Final Provisions

    This Agreement sets out the terms and conditions that apply to the use of the Thecodewizarhub Site Offerings. Using the Site Offerings means you agree to be bound by this Agreement. If you don't agree to all of the terms of this Agreement, you cannot use the Site Offerings. This Agreement takes precedence over any inconsistent or conflicting provisions related to the Site Offerings. Thecodewizarhub inability to enforce any part of this Agreement does not mean Thecodewizarhub cannot enforce it in the future. This Agreement does not create any agency or partnership between the parties. Any part of this Agreement that is found to be invalid or unenforceable shall not affect the validity and enforceability of the remaining provisions of the Agreement and it will be interpreted according to applicable law. Thecodewizarhub can assign its rights and obligations under this Agreement to any third party at any time without notice. The headings in this Agreement are for reference only and do not explain, limit, or define any section.

26. Force Majeure

    Neither party shall be liable for any breach or termination of this agreement due to a force majeure event; an unforeseen event beyond the reasonable control of the parties which among others includes act of God, strikes, lockouts, pandemics, epidemics, war, floods and earthquakes. The affected party shall duly notify the other party and do its best effort to minimize the impact on its obligations. Both parties can terminate in writing this agreement without liability, if the force majeure event continues for more than 30 days.

27. Feedback and Suggestions

    Any suggestions and feedbacks provided to Thecodewizarhub are subject to Thecodewizarhub’s Intellectual Property and you acknowledge that Thecodewizarhub may be used them for further development and improvement of the site offerings, to enhance Thecodewizarhub data security and fraud prevention capabilities and to comply with any applicable laws.
